A federal appeals court dismissed a woman's claim that a Delaware County Sheriff's deputy violated her husband's constitutional rights when he shot and killed him during a domestic disturbance call in 2018.
The Sixth Circuit United States Court of Appeals upheld a lower court's determination that deputy Zachary Swick acted within reason when he shot and killed Brian Puskas at his home in Sunbury.
Deanna Puskas had called 911 and reported her husband was threatening her with knives and guns.
Court documents state Swick and several other law enforcement officers arrived and tried to deescalate the situation, but shot the man after he picked up a revolver about 30 minutes after the call.
She later argued in court documents that her husband was on new medication and the officers used excessive force.
