The U.S. Supreme Court will not consider reinstating the conviction of a former Dayton-area police officer charged in connection with his wife's death.
The court ruling on Monday essentially leaves in place a lower court ruling that vacated the conviction of Jim Barton.
That ruling said authorities improperly withheld evidence that could have helped Barton fight involuntary manslaughter charges.
Prosecutors alleged Barton paid to stage a burglary to scare his wife into moving from their farm into Springboro, where he wanted to become police chief. Authorities said she was killed when the burglary went awry.
A jury convicted Barton in 2005 of involuntary manslaughter and aggravated burglary.
