A federal appeals court has dismissed a wrongful death lawsuit brought by the estate of a man found dead in a dirty Columbus jail cell.
The 6th U.S Circuit Court of Appeals in Cincinnati determined there was insufficient evidence to find the Franklin County Sheriff's Office acted maliciously or recklessly in the 2011 death of 48-year-old Edward Peterson. Peterson died from a pre-existing heart condition.
The lawsuit said jail officials should've seen warning signs of his heart condition.
The court says Peterson didn't tell medical staff he had congestive heart failure and didn't authorize release of his medical information. The court also found there wasn't evidence that two deputies knew Peterson needed emergency medical attention.
An attorney for Peterson's estate couldn't be reached for comment.
