The Ohio Supreme Court has rejected a wrongful imprisonment claim from an ex-offender who sued after the sex offender registration law he violated was declared unconstitutional.
The court's 6-1 ruling Thursday found that reversing a conviction on constitutional grounds is not the same thing as the crime having never occurred.
At issue was the 2008 failure by convicted sex offender David Bundy to register with the Montgomery County Sheriff's Office as required under law.
After Bundy was convicted of violating the registration law and sent to prison, the state Supreme Court found the law unconstitutional and reversed his conviction.
Bundy won successful rulings in two lower courts before the Supreme Court said Thursday his case didn't meet the actual-innocence standard required for wrongful imprisonment claims.
